Data privacy

Data protection is very important to us. This privacy policy gives details of the collection of personal data during use of our website. Personal data means any information concerning you personally, such as your name, address, e-mail address or user behaviour. We have taken extensive technical safety measures in our company to protect your data from accidental or intentional manipulation, loss, destruction or from access by unauthorised parties. Our security measures are regularly reviewed and updated to reflect technological developments.

3 Purpose of and legal basis for data processing

We collect personal data only where you choose to disclose them yourself, such as when you complete our contact form. We use these data for no other purpose than the one for which you have disclosed them. They will be used for other purposes only after you have been expressly informed of this and given your consent, in accordance with Article 6 (1) (a) GDPR. In certain cases, personal data are processed because of a legitimate interest under Article 6 (1) (f) GDPR (see Item 4 below).

4 Processing because of a legitimate interest under Article 6 (1) (f) GDPR

The processing of personal data based on Article 6 (1) (f) GDPR is carried out in the cases listed below.

4.1 Collection of personal data during visits to our website

When our website is used solely for information purposes, we collect only those personal data that are sent to our server by your browser. When you view our website, we collect the data listed here, which are technically required to display our website and to ensure stability and security:
– IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, data volume transmitted, website where the request originated, browser, operating system and user interface, browser language and version.
The controller’s legitimate interest is the correct display of his website and the safeguarding of website stability and security.

4.2 Web analytics

For the purposes of web analytics and website optimisation, we rely on a range of services, which are presented in detail below. They allow us to analyse, for instance, how many users visit our pages, what information is most frequently sought, or how users find our website. We collect information such as the page where a data subject’s request to our site originated (a so-called referrer), what subpages were accessed, or how frequently and for how long a subpage was viewed. This information helps us to optimise our site and make it more user-friendly. The data collected do not serve to identify individual users. We only collect anonymised or at most pseudonymised data. Article 6 (1) (f) GDPR forms the legal basis for this.
The controller’s legitimate interest is the optimisation of his website using web analytics tools.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland.  including the version Universal Analytics. This permits assigning data, sessions and interactions a pseudonymised user ID across several devices, which allows the cross-device analysis of a user’s activities.
Google Analytics uses cookies that enable us to analyze your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the US and stored there. In the event of activation of IP anonymisation on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic AreaOnly in exceptional cases the full IP address will be sent to a Google server in the US and shortened there. The IP address transferred by your browser as part of Google Analytics will not be merged with other Google data. Salesforce

This website uses Salesforce. This is a customer relationship management (CRM) software for placing advertisements and responding to customer concerns and inquiries. The service provider is Salesforce.com Inc, Salesforce Tower, 415 Mission Street, 3rd Floor, San Francisco, CA 94105, United States of America.
Salesforce uses cookies for this purpose. The following personal data is processed: Service user actions, browser type, device identifier, device information, files viewed, location information, internet service provider, IP address, mobile application information, operating system information, system configuration information, usage data, user agent, date and time of request, pages viewed, search queries. This only happens if you have expressly given your consent in accordance with Art. 6 s. 1 a GDPR. You can, of course, withdraw your consent at any time. Data processing generally takes place within the European Union. In individual cases, the service we use may pass on the collected data to Salesforce Inc. in the USA and to other contractual partners of Salesforce. In this case, there is a risk that your data may be processed by US authorities for control and monitoring purposes, without you possibly having any legal remedies. Retention period is the length of time that the collected data is stored for processing. The data is erased as soon as it is no longer needed for the processing purposes. The maximum retention period for cookies is 1 year.

4.3 Advertising

We may share this information with third parties, such as ad networks. Article 6 (1 a) and (f) GDPR form the legal basis for this. The purpose of this data processing is the legitimate interest of direct marketing. You have the right to object at any time to the processing of your data for the purpose of such advertising. For this purpose, we have provided you with opt-out options for the individual services below. Alternatively, you can prevent the use of cookies in your browser settings.

Google Tag Manager

Please note that we use Google Tag Manager by Google Ireland Limited (Register-No: 368047), Gordon House, Barrow Street, Dublin 4, Ireland. Google Tag Manager itself does not collect any personal data. Google Tag Manager facilitates the embedding and administration of tags on our websites. Tags are small code elements which enable us to measure website traffic and user behaviour andto record the impact of our advertising activities and social networks, to test and optimise our websites for our interest groups. We use Google Tag Manager in combination with Google Analytics. If you have deactivated the service, the deactivation will be considered by Google Tag Manager. Meta Pixel (formerly Facebook Pixel)

To measure conversion rates, this website uses the visitor activity pixel of Facebook/Meta. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook’s statement the collected data will be transferred to the USA and other third-party countries too.

This tool allows the tracking of page visitors after they have been linked to the website of the provider after clicking on a Facebook ad. This makes it possible to analyze the effectiveness of Facebook ads for statistical and market research purposes and to optimize future advertising campaigns.

For us as the operators of this website, the collected data is anonymous. We are not in a position to arrive at any conclusions as to the identity of users. However, Facebook archives the information and processes it, so that it is possible to make a connection to the respective user profile and Facebook is in a position to use the data for its own promotional purposes in compliance with the Facebook Data Usage Policy (https://www.facebook.com/about/privacy/). This enables Facebook to display ads on Facebook pages as well as in locations outside of Facebook. We as the operator of this website have no control over the use of such data.

The use of these services occurs on the basis of your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. You may revoke your consent at any time.

Insofar as personal data is collected on our website with the help of the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Art. 26 DSGVO). The joint responsibility is limited exclusively to the collection of the data and its forwarding to Facebook. The processing by Facebook that takes place after the onward transfer is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The wording of the agreement can be found under: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the privacy information when using the Facebook tool and for the privacy-secure implementation of the tool on our website. Facebook is responsible for the data security of Facebook products. You can assert data subject rights (e.g., requests for information) regarding data processed by Facebook directly with Facebook. If you assert the data subject rights with us, we are obliged to forward them to Facebook.

You also have the option to deactivate the remarketing function “Custom Audiences” in the ad settings section under https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do this, you first have to log into Facebook.

If you do not have a Facebook account, you can deactivate any user-based advertising by Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

The company is certified in accordance with the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the US, which is intended to ensure compliance with European data protection standards for data processing in the US. Every company certified under the DPF is obliged to comply with these data protection standards. LinkedIn

When you visit our LinkedIn company page, there is a joint controllership with LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (https://www.linkedin.com/help/linkedin/solve) for processing your personal data. We use our LinkedIn page to inform and communicate with you as a user and interested party of our offer or as a potential employee/applicant. In accordance with LinkedIn’s terms of use, which each user has agreed to as part of creating a LinkedIn profile, we may identify subscribers to the page and view their profiles and other shared information from them. For example, your LinkedIn name and their profile picture are visible to us (and other LinkedIn users) when you visit our site or comment on posts by us. We therefore only collect the personal data that has become an obvious part of our LinkedIn page through corresponding cooperation on your part. We have no interest in collecting and further processing your individual personal data for marketing purposes. Accordingly, we use the data at most to adapt and improve our offer.

LinkedIn uses cookies, i.e. small text files that are stored on the various end devices of the users, to store and further process this information. According to LinkedIn, the cookies used by LinkedIn are used for authentication, security, preferences, functions and services, personalized advertising, and analysis and research. LinkedIn’s privacy policy contains further information on data processing.
The operation of the LinkedIn site involving the processing of users’ personal data is based on Art. 6 s. 1 f GDPR for the implementation of our legitimate interests in an information and interaction opportunity via LinkedIn for and with our users and visitors. Further legal bases for data processing may arise in individual cases from Art. 6 s. 1 a, b, c GDPR.
We delete personal data insofar as the purpose of the data processing has been achieved and there are also no other legal grounds against deletion of the data. We generally delete private messages in our LinkedIn account manually after 12 months.

Newsletter

You can subscribe to various newsletters on some of our websites or as part of promotions such as competitions, with which we inform you about the activities of our company, current information about our services, special offers, promotions and events. The content of the individual newsletter is briefly described in the context of the registration. The legal basis for sending the respective newsletter is your consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO in conjunction with § 7 Para. 2 No. 3 UWG or the legal permission in accordance with § 7 Para. 3 UWG.
We use the so-called Double-Opt-In-Procedure for the registration to our newsletters. This means that after your registration we will send you an e-mail to the e-mail address you have provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be automatically deleted after 14 days.
Only your last name and your e-mail address are required for sending the newsletter. The provision of further data is voluntary: this data is used to address you personally. After your confirmation, we store your e-mail address for the purpose of sending the newsletter and until revoked. We also store your IP address current at the time of registration, the time of registration and the confirmation within the scope of legal obligations to retain data. The purpose of this procedure is to be able to prove your registration in case of doubt and, if necessary, to clarify any misuse of your personal data. The legal basis for the logging of the registration is our legitimate interest in accordance with Art. 6 Para. 1 S.1 lit. f DSGVO in proof of a previously given consent, see also Art. 7 Para. 1 DSGVO.
You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can revoke your consent by clicking on the link provided in each newsletter-e-mail or by sending an e-mail to newsletter@flamro.com.

Vimeo

We also use videos from the company Vimeo on our website. The service provider of this video portal is Vimeo LLC, 555 West 18th Street, New York, New York 10011, USA. With the help of a plug-in, we can show you interesting video material directly on our website. In the process, your personal data may be transferred to Vimeo.
The aim of our web presence is to provide you with the best possible content. Vimeo offers us the opportunity to present you with high-quality content directly on our website. This expands our service and makes it easier for you to access interesting content. Thus, in addition to our texts and images, we also offer videos.

What data is stored on Vimeo?

When you call up a website on our website that has a Vimeo video embedded, your browser connects to the Vimeo servers. This results in a data transmission. This data is collected, stored and processed on the Vimeo servers. Regardless of whether you have a Vimeo account or not, Vimeo collects data about you. Vimeo uses this data to improve its own service. The legal basis for this is Article 6 s. 1 f GDPR. If your data is used, for example, to set up our own targeted advertising measures, this is done on the basis of your consent pursuant to Art. 6 s. 1 a GDPR.

How long and where is the data stored?

Vimeo has its headquarters in White Plains in the state of New York (USA). However, the services are offered worldwide. The company uses computer systems, databases and servers in the USA and also in other countries. Your data can therefore also be stored and processed on servers in America. The data remains stored by Vimeo until the company no longer has an economic reason for storing it. Then the data is deleted or anonymised.
In order to ensure an appropriate level of data protection when transferring data to the USA, we have concluded EU standard contractual clauses with the provider of Vimeo in the so-called “controller to controller” variant. As further protective measures, we always integrate videos from Vimeo in the “Do Not Track” variant, so that personal data is only transmitted to Vimeo in a minimal way.

How can I delete my data or prevent data storage?

You always have the option to manage cookies in your browser according to your wishes. For example, if you do not want Vimeo to set cookies and thus collect information about you, you can delete or disable cookies in your browser settings at any time. Please note that after deactivating/deleting cookies, various functions may no longer be available to the full extent.
If you are a registered Vimeo member, you can also manage the cookies used in the settings on Vimeo.

YouTube (extended privacy mode)

We use services from YouTube, LLC 901 Cherry Ave, 94066 San Bruno, CA, USA, a Google Inc. company, Amphitheatre Parkway, Mountain View, CA 94043, USA, on our website. Here, we use the option of extended data protection provided by YouTube to protect your personal data. When you call up a page in which a YouTube video is embedded, a connection is established to the YouTube servers and the content is displayed on the website by informing your browser. According to YouTube’s information, however, data is only transmitted to the YouTube server in “extended data protection mode” when you actively start the video. If you are logged in to YouTube at this time, the information about the videos you have viewed will be assigned to your member account with YouTube. You can prevent this by logging out of your member account before visiting our website. Insofar as data is processed outside the European Economic Area / the EU, where there is no level of data protection equivalent to the European standard, Google states that it uses standard contractual clauses.

4.4 Use of cookies

When you use our website, cookies are stored on your computer. Cookies are small text files that are stored on your hard disk and associated with the browser you use. They send specific information to the organisation setting them. Cookies cannot execute applications or transmit viruses to your computer. They serve to make the overall web experience more user-friendly and efficient.
Article 6 (1) (f) DGPR forms the legal basis for the processing of personal data using cookies. The controller’s legitimate interest is the user-friendly and more efficient design of his website.

Transient cookies

Transient cookies are deleted when you close the browser. They include, in particular, session cookies. These cookies store a co-called session ID that permits assigning different requests from your browser to a specific session. Your computer can then be identified when you return to our website. Persistent cookies

The personal data we collect will be deleted when the purpose of processing for which they were stored no longer applies or within the statutory retention periods.

When using our website, you are under no statutory or contractual obligation for provision.

8 Existence of automated decision-making, including profiling

There is no automated decision-making, including profiling, as per Article 22 GDPR.

9 Your rights

As a data subject, you have the following rights regarding your personal data:

9.1 General rights

You have the right of access; the right to rectification, erasure and restriction of processing; the right to object to processing; and the right to data portability. Where processing is based on your consent, you have the right to revoke your consent with effect for the future.

9.2 Rights in respect of data processing based on a legitimate interest

Under Article 21 (1) GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you based on Article 6 (1) (e) GDPR (Data processing that is in the public interest) or Article 6 (1) (f) GDPR (Data processing for the purposes of a legitimate interest), including profiling based on those provisions. When you object, we will no longer process your personal data, except where we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where the processing serves for the establishment, exercise or defence of legal claims.

9.3 Rights in respect of direct marketing

Where we process your personal data for direct marketing purposes, you have the right under Article 21 (2) GDPR to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
When you object to the processing of your personal data for direct marketing purposes, we will no longer process your personal data for these purposes.

9.4 Right to lodge a complaint with a supervisory authority

In addition, you have the right to lodge a complaint with a competent supervisory authority regarding the processing of your personal data by us.

10 Contact via e-mail or via a contact form

When you contact us via e-mail or via a contact form, the data you submit (your e-mail address, first name and last name) are stored by us in order to respond to your enquiry. Any information requested in our contact form that is not necessary to contact you is marked as optional. These details help us better understand your enquiry and permit improved handling of your request. Communication of these details is entirely voluntary and with your consent, Article 6 (1) (a) GDPR. Where these are details concerning communication channels (such as an e-mail address or telephone number), you also consent to being contacted by us via these channels to respond to your enquiry. You can, of course, revoke your consent with effect for the future at any time.
We will delete the data concerned when storage is no longer required, or we will restrict the processing of data that are subject to statutory retention periods.

11 Data transfers and intended data transfers to a third country or international organisation

We will never transfer your personal data to third parties, except where we are legally required to do so, or where the transfer of these data is required for the performance of a contract, or where you have given your express consent to the transfer of your data.

We have taken extensive technical safety measures in our company to protect your data from accidental or intentional manipulation, loss, destruction or from access by unauthorised parties. Our security measures are regularly reviewed and updated to reflect technological developments.
